Welcome to Contablika. These Terms and Conditions (“Terms”) govern access to and use of the contablika.com website, as well as related SaaS services, features, applications, modules, or add-ons (collectively, “the Service”). By registering for, accessing, or using the Service, you agree to these Terms in their entirety. If you do not agree to any of these terms, please do not use the Service.
For the purposes of these Terms:
User: a natural or legal person who accesses or uses the Service.
Account: the set of credentials (username, password) that allow for the use of the Service.
User Data: any information, documents, files, or other material that the User (or their clients) uploads, stores, or processes using the Service.
Provider / We / Contablika: the entity that owns and operates the Service.
Premium Services / Paid Plans: additional features, modules, or access levels that require payment.
Privacy Policy: the document describing how we collect, use, share, and protect User Data.
To use the Service, you must create an Account with accurate, complete, and up-to-date information.
You are responsible for maintaining the confidentiality of your credentials and for any activity that occurs under your Account.
You must immediately notify Contablika if you detect unauthorized use of your Account or any security breach.
Contablika reserves the right to suspend or close accounts if misuse or violations of these Terms are detected.
Contablika grants you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
You may not (and will not allow third parties to) use the Service to:
violate applicable laws;
modify, decompile, disassemble, or attempt to discover source code (except to the extent permitted by applicable law);
use the Service to distribute malware, spam, or other malicious content;
interfere with, damage, or disable the operation of the Service or the underlying infrastructure;
access, extract, or copy data from the Service for commercial or systemic purposes without authorization.
Contablika will offer one or more free-use plans (“Free”) and paid plans (“Premium”, “Corporate”, etc.) with varying capacities, features, and limits.
Use of Premium features is subject to payment of the fees stipulated at the time of contracting.
Payment shall be made via available methods (credit card, debit card, payment gateway, etc.).
The User is responsible for any applicable taxes associated with the service.
Contablika may modify plan prices and terms, subject to reasonable advance notice.
In the event of cancellation, suspension, or termination of the Account, the User shall not be entitled to a partial refund unless expressly agreed otherwise.
All content, design, software, code, trademarks, logos, and documentation related to the Service are the exclusive property of Contablika or its licensors and are protected by copyright, trademark, and other applicable laws.
You are not granted any ownership rights to the Service or its protected elements, except for the limited license mentioned in Section 3.
If you upload content (User Data), you retain ownership of that data, but you grant us a non-exclusive license to use, process, store, and display that data in the provision of the Service.
Contablika and the User agree to treat as confidential all information designated as confidential or that should reasonably be understood as such.
The Privacy Policy describes how we collect, process, and protect User Data, and forms an integral part of these Terms.
Contablika will implement reasonable security measures to protect data against unauthorized access, loss, alteration, or disclosure.
The Service is provided “as is” and without express warranties, except for those that cannot be limited by law.
Contablika does not guarantee that the Service will be uninterrupted, error-free, or completely secure.
To the maximum extent permitted by law, Contablika shall not be liable for:
indirect, incidental, special, punitive, or consequential damages;
loss of data or lost profits;
third-party claims arising from the User’s use of the Service.
Contablika’s total liability to the User under any circumstances is limited to the total amount paid by the User during the preceding 12 months (or the corresponding value, if the relationship lasted less than 12 months).
We may temporarily suspend access to the Service if there is a suspicion of misuse, a security breach, or a violation of these Terms.
We may permanently terminate your account in the event of a serious breach.
Upon termination, your access to the Service will cease, and Contablika may delete or erase stored User Data, unless there is a legal obligation to retain it for an additional period.
Obligations regarding confidentiality, limitations of liability, intellectual property, and other provisions that by their nature should survive termination will remain in effect after the service ceases.
Contablika may modify these Terms by providing reasonable advance notice to the User—via email, through the system, or by a notice on the site. If the User does not accept the changes, they may stop using the Service. Continued use following the changes constitutes acceptance.
Governing Law and Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of the Republic of Panama (or the jurisdiction you specify). The parties submit to the competent courts of Panama (or other relevant region).
Entire Agreement: These Terms constitute the entire agreement between the parties regarding the Service, superseding any prior understandings.
Severability: If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
No Waiver: Failure to exercise a right does not constitute a waiver of that right.
Notices: Communications between the User and Contablika shall be made via email or system notifications, directed to the addresses provided by each party.
